Pittsburg Arts Council Association Fan Art Policy

The Pittsburg Arts Council Association has established a Fan Art Policy to clarify our stance on the creation and display of fan art. Fan art is artwork inspired by popular works of fiction or Intellectual Property (IP) owned by other entities (such as books, sports teams, movies, music, etc.) created by fans.

Examples of Fan Art IP Include (but are not limited to) Marvel, DC, Disney, Netflix, film franchises, sports logos, musical artists, characters, symbols, and other branded content that belong to their respective IP holders. These entities typically maintain creative control and legal protection over the use of their IP.

While we acknowledge that fan art and fandom culture inspire many artists and play a role in developing their businesses, we strongly discourage the sale of fan art during Pittsburg Arts Council Association events. This policy aims to help artists avoid potential copyright infringement issues. However, artists may display fan art at their booths under the following conditions:

Display Guidelines for Fan Art:

  • The artwork must be an original, creative design by the artist. It cannot be a direct tracing, reproduction, or AI-generated composite of another artist’s work or product.
  • Artists must also showcase original non-fan art pieces at their booths.
  • If fan art is displayed, a clear disclaimer stating that it is unofficial fan content must be visible at the booth and near the artwork.

While the Pittsburg Arts Council Association does not condone the sale of fan art, if you choose to do so, please ensure that it adheres to Fair Use practices and avoid any infringement on the intellectual property rights of others. You must not claim that fan art is your original concept or idea.

Liability Disclaimer:

If the rightful copyright holder takes legal action, the Pittsburg Arts Council Association will not be held liable. By displaying or selling fan art at any Pittsburg Arts Council event, you agree to indemnify and hold harmless the Pittsburg Arts Council Association, its officers, and directors from any claims or legal actions arising from the sale of such artwork.
